WHO CAN EXERCISE THE RIGHTS?

The rights of the interested parties are highly personal, therefore, they will be exercised by the owner of the data, duly proving their identity (for this purpose, they will be asked for their ID card or equivalent).

They may also be exercised through legal representation, in which case, in addition to the ID card or equivalent of the data subject, the ID card and authentic document proving the representation of the third party must be provided.


WHAT IS OUR OBLIGATION WHEN YOU EXERCISE ANY OF THESE RIGHTS?

The data controller must respond to any request made to them, regardless of whether or not the data subject's personal data is included in their processing.

If the request does not meet the specified requirements, the data controller must request that the necessary corrections be made.

In accordance with current and applicable regulations on personal data protection and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), POINT SL informs users that it has created a profile on the social networks Facebook, Instagram, Pinterest, LinkedIn, and YouTube, with the main purpose of advertising its products and services.

The user has a profile on the same Social Network and has decided to join the page created by POINT SL, thus showing interest in the information advertised on the Network. By joining our page, you give us your consent to process the personal data published on your profile.

Users can access the social network's privacy policies at any time, as well as configure their profile to ensure their privacy.

POINT SL has access to and processes the user's public information, in particular their contact name. This data is only used within the social network itself. It is not incorporated into any processing system.

Rights of data subjects

With regard to your rights of access, rectification, restriction of processing, erasure, portability, and objection to the processing of your personal data, which you may exercise before POINT SL in accordance with the GDPR, you should bear in mind the following nuances:

POINT SL will perform the following actions:

Access to public profile information. 

Publication on the user's profile of all information already published on the POINT SL website. Send personal and individual messages through the social network channels.


Updates to the status of the page that will be published on the user's profile.

Users can always control their connections, delete content that no longer interests them, and restrict who they share their connections with by accessing their privacy settings.


Publications

Once users have joined the POINT SL page, they may publish comments, links, images, photographs, or any other type of multimedia content supported by the social network. In all cases, users must be the owners of such content, hold the copyright and intellectual property rights, or have the consent of the third parties concerned. Any publication on the page, whether text, graphics, photographs, videos, etc., that violates or is likely to violate morality, ethics, good taste, or decorum, and/or that infringes, violates, or breaches intellectual or industrial property rights, image rights, or the law is expressly prohibited. In such cases, POINT SL reserves the right to immediately remove the content and may request the permanent blocking of the user.

POINT SL shall not be held liable for content freely published by users.

Users should bear in mind that their posts will be seen by other users, so they themselves are primarily responsible for their privacy.

Images that may be published on the page will not be stored in any processing system by POINT SL, but will remain on the Social Network.


Contests and promotions 

POINT SL reserves the right to hold contests and promotions in which users who have joined its page may participate. The rules for each contest or promotion, when the Social Network platform is used for this purpose, will be published on the platform. This will always be done in compliance with the LSSI-CE and any other applicable regulations.

The Social Network does not sponsor, endorse, or administer any of our promotions in any way, nor is it associated with any of them.


Advertising 

POINT SL will use the Social Network to advertise its products and services. In any case, if it decides to process your contact details for direct commercial prospecting, it will always do so in compliance with the legal requirements of data protection regulations and the LSSI-CE.

Recommending the POINT SL page to other users so that they too can enjoy the promotions or be informed of its activity will not be considered advertising.
